강남레깅스룸 [오늘과 내일/서정보]6년 전 그때 방송법을 바꿨더라면…

당시의 사장 교체는 먼저 방통위원 교체→감사 등을 통한 KBS와 MBC 방문진 야권 이사 해임→여권 추천 이사로 교체→사장 해임 제청→대통령 재가→새 사장 임명 제청→대통령 재가 순으로 이뤄졌다. 이 과정에서 정권의 압박을 견디지 못한 이사들은 스스로 물러났다. 끝까지 버틴 강규형 당시 KBS 이사의 경우엔 해임 단골 사유인 법인카드 문제로 해임됐다가 3년 8개월간의 소송 끝에 승소했다.이번에도 크게 다르지 않은 방식으로 이사 교체와 사장 해임을 진행했다. 다만 KBS는 김의철 전 사장 해임까진 나아갔으나 여권 이사들의 자중지란으로 새 사장 임명이 무기한 연기되고, MBC는 권 이사장의 해임 무효 가처분신청이 받아들여져 당분간 손을 쓸 수 없는 처지인 것만이 다를 뿐이다.공영방송의 거버넌스를 복잡하게 만드는 건 언론노조의 존재도 한몫한다. KBS 보도를 책임지는 보도본부장은 3번 연속 언론노조 KBS위원장 출신이다. MBC는 언론노조 MBC위원장들이 번갈아 사장을 맡았다. 언론노조는 최근의 이사, 사장 해임과 관련해 ‘방송의 독립 침해’라고 주장하지만 5년 전에 그들이 이사, 사장 해임에 적극 나섰다. 그들은 적폐 청산을 명목으로 이사들의 사무실, 강의실을 찾아가 압박했다. 그들이 지금에서야 방송 독립을 얘기하는 것은 5년 전의 자신을 부정하는 일이다. 방송의 독립은 노조가 중간에 끼어 영향력을 행사하는 현실에선 허구와도 같다.그래서 공영방송의 이사와 사장 임명 체계에 개혁이 필요하단 얘기는 오래전부터 나왔다. 하지만 야당일 때는 주장하다가 여당이 되면 나 몰라라 했다. 여야가 유일하게 동의했던 방송법, 방송문화진흥법 개정안 등은 2016년 민주당이 마련한 것이었다. 여야 추천 공영방송 이사의 비율을 현재 7 대 4(KBS), 6 대 3(MBC)에서 7 대 6으로 바꾸고, 사장 임명 제청 시 재적이사 3분의 2가 찬성하도록 한 것이다. 야당의 동의를 얻은 사장을 임명하자는 취지였다. 하지만 2017년 8월 업무보고를 받은 문재인 대통령은 “최선은 물론 차선도 아닌 기계적 중립을 지키는 사람을 공영방송 사장으로 뽑는 것이 도움이 되겠는가”라고 말했다. 이후 법안들은 논의 없이 흐지부지됐고 20대 국회가 끝나면서 함께 폐기됐다. 당시 법안들이 통과됐다면 지금과 같은 교체 파동은 없었을 것이다.공영방송은 사회의 갈등을 조정하고 완화하는 공론장 역할을 해야 한다. 하지만 사회의 갈등을 해소하기는커녕 더욱 증폭시키고 스스로 갈등의 생산자가 되고 있다. 정권은 공영방송을 자기편으로 만들려 하고, 이미 특정 정치세력에 기울어진 노조가 있기 때문에 정권이 바뀔 때마다 홍역을 치를 수밖에 없다. 공영방송의 필수 요소인 불편부당함을 ‘기계적 중립’이란 이상한 용어로 바꿔 배척하는 한, 방송의 독립에 정권과 노조로부터의 독립을 아우르지 않는 한 현재의 공영방송은 ‘갈등 조장자’일 뿐이다.
